With Kourtney Kardashian rumored to be expecting her third child the reality star is currently fighting a paternity suit against a male model claiming to be her son Mason's father.

Michael Girgenti is claiming that he had an affair with Kardashian during her relationship with boyfriend Scott Disick when the couple was "on the outs" and that he is the father of the 3-year old child rather than Disick.

According to TMZ, Girgenti wrote a letter to the "Keeping Up with the Kardashians" star urging her to submit to a DNA test.

Radar Online is claiming that the model expressed to Kourtney Kardashian that he did not want to drag her and her boyfriend through the courts over the situation in a letter.

According to the Daily Mail, Girgenti wrote, "My attentions [sic] are not to hurt the family you've created with Scott."

"Please take this final request for a DNA test seriously," he went on to say, "Because if you don't, I will be forced to take legal action and sue."

He added, "I assure you I don't take being a father lightly. I will be a great father to Mason."

Girgenti filed paperwork at a Los Angeles County Superior Court against Kim Kardashian's older sister in a bid to get joint custody of Mason after alleging that he had unprotected sex with the reality star nine months before the boy's birth.

The model requested that the judge order DNA tests for Kourtney Kardahian, Mason Dash Disick, and boyfriend Scott Disick, who is father to her daughter Penelope, 1.

A hearing has been set for next month. Kardashian has yet to publicly comment on the current lawsuit but her lawyer Todd Wilson told TMZ that the allegations are "absurd."

He went on to say, "This individual has been selling false and fabricated stories to the tabloids for years about Kourtney Kardashian and her son, Mason. Scott Disick is Mason's father."

He added, "We have not seen the reported court filing, but we are informed that this individual has been seeking to get paid to publish his ridiculous pleading.

"His claims are absurd and this is simply another shameful attempt to gain publicity and profit from fictional stories about my client."
