Christian Louboutin, YSL, DVF , Balenciaga etc. are some of the popular brands who have made news for the various lawsuits filed by them or against them.
Yves Saint Laurent v/s Christian Louboutin: A case that started in April 2011finally came to a close in October 2012. The debacle over the red-soled shoes started when YSL launched red color pump shoes with red soles for its Resort 2011 collection. Claiming a trademark infringement, Louboutin slapped a $1million suit against the former. But the court ruled that while Louboutin did have the exclusive rights to red soles, the brand couldn't claim infringement if the upper part of the shoes too were red. And the best part? It's no one's loss.
Alexander McQueen v/s Hells Angels: Hells Angels Motorcycle Corporation filed one of the most popular trademark infringement lawsuits against designer Alexander McQueen in October 2010, according to The Daily Mail. Citing the unlawful use of a trademark design that was similar to that of the Winged Death's Head, Hells Angel had sued McQueen. As a result, the designer agreed to remove the merchandise from stores and also recalled and destroyed the pieces that had already been sold.
DVF v/s Forever 21: In March 2007, Diane von Furstenberg sued Forever 21 for poaching her designs; Cerisier and Aubrey. And yes they do look very similar. DVF requested the court to order Forever 21 to recall and remove the designs from commercial distribution. The complaint also asked for financial damages that weren't revealed.
In the same year, Forever 21 was also sued by Anna Sui Corporation, Sweet People Apparel, Coast to Coast Fabrics, Bebe Stores and Anthropologie, all under Intellectual Property Rights.
Balenciaga v/s Steve Madden: Balenciaga sued shoe brand Steve Madden in December 2009 for copying its Lego heels with multicolored buckles from the 2007 fall collection. The Balenciaga pair, which sold for $4,175, according to nymag.com, became immensely popular after Beyonce donned them for the American Music Awards. The copied version of the heels was released in 2008 and sold for $99.95. Balenciaga and Madden settled the case out of court and none of the details were revealed.
Madden was also sued by Alexander MacQueen in October 2009 for a similar design infringement case involving McQueen's Faithful Bootie.
