Phew! It’s finally over. All the Christian Louboutin and Yves Saint Laurent fans can heave a sigh of relief. The red soled lawsuit between the two fashion giants has final come to a close according to styleite.com. And the best part? It’s no one’s loss. But the iconic red soles managed to create quite a stir.
Yves Saint Laurent has dropped its lawsuit against Christian Louboutin over the red soled shoes for good. Both the parties seem to be satisfied with the court decision which permitted YSL to make monochromatic red shoes in which the upper part of the footwear as well as the sole is red in color. Not just that, it has also decided to uphold Louboutin’s 2008 trademark protection over the red sole alone.
The case began in April 2011 when Louboutin sued YSL when the latter came out with a red color pump shoes with red soles for its Resort 2011 collection and the suit demanded $1 million in damages. During the hearing, a New York district judge ruled that Louboutin did have exclusive rights to red soles, but dismissed the claims that YSL's all-red shoes were in any way a breach of Louboutin’s trademark. Following this decision the case was referred to the appeals court.
The case was resolved in September when the appeals court ruled that Louboutin’s red sole trademark is not effective as long as YSL’s shoe is all red, including the upper part.
Louboutin previously had also sued another fashion major, Zara for its red soled peep toe slingback claiming that it was similar to the former’s Yo Yo slingbacks. But the court ruled that the footwear by the two brands were not similar and also ordered Louboutin to pay $3600 approx to Zara as compensation.
Whatever the case maybe Louboutin’s shoes are a style statement in themselves and are patronized by various celebs like Victoria Beckham, Sara Jessica Parker, Jessica Biel, Blake Lively, Taylor Swift and many more.
