Katie Holmes filed for divorce to Tom last Thursday June 28, 2012 in New York, citing irreconcilable differences. Katie wants sole custody of the couples daughter Suri. 

Katie has hired New York based lawyer Jonathan Wolfe who released a statement saying, "This is a personal and private matter for Katie and her family," adding "Katie's primary concern remains, as it always has been, her daughter's best interest." 

Tom's publicist said the 'Rock of Ages' actor was "deeply saddened" by Katie Holmes' divorce filing last week, and according to sources decision came as a "complete surprise."

Katie's reason to file in New York courts was a tatical move, with New York courts more willing to provide sole custody of Suri to Katie. California law differs than that of New York which allows more rulings for the benefit of the child.  

The couples deed to the New York apartment is in Katie's name, according to TMZ reports. Tom signed over the deed to Katie last year to avoid high taxes in NYC.   

Tom recently hired famed divorce lawyer Dennis Wasser of Law firm Wasser, Cooperman & Carter, P.C. Dennis helped Tom in his previous divorce to Nicole Kidman.  The law firm specializes in divorce issues, child support and child custody cases, and had recently represented Kim Karashian in a high profile divorce with Kris Humphries. 

Rumors have been spreading that Tom's association with Scientology may be one of the reasons for the divorce. TMZ reports that Tom was going to send 6-year-old Suri away to a hardcore Scientology organization known as Sea Organization, and Katie believes she is being followed by the Church of Scientolgy. Church of Scientology Lawyer Gary Soter responded to the allegations stating that the Church is not following Katie or conducting surveillance on her in the wake of her divorce with Tom.
