The French court ruled that Christian Louboutin's case agianst Zara that they copied his Yo Yo slingbacks has does merit infringement.
Zara appealed against Louboutin's decision to sue by saying that customers would not be confused between Louboutin's shoes which sells for 395 euros ($495) to 49 euros ($61). According to WWD the French court sided with Zara and sentenced Louboutin to pay compensation.
Christian louboutin is a French footwear designer whose footwear has unique shiney, red-lacquered soles that has become the signature brand. Louboutin designed shoes for Chanel, Yves Saint Laurent (YSL), Maud Frizon in the past. Louboutin started his brand in 1991 selling his unique shoes to Princess Caroline of Monaco his first customer. since then celebrities have worn his shoes from Kim Kardashian to Lady Gaga.
Previously, in 2011 U.S. District Judge Victor Marrero in New York, sided with Yves Saint Laurent in the case of trademark infringement of the red-soled shoes against designer by Louboutin.
Louboutin's general manager Alexis Mourot stated the company will continue to carry the battle over the red-soled brand.
Louboutin in an interview with french newspaper Libération stated why his signature red-soled shoes are important to him stating "Cadbury recently won a lawsuit against Nestlé for using purple packaging." adding "All this proves that colours play a part in a brand's identity. I'm not saying that red usually belongs to me - I repeat that this is about a precise red, used in a precise location.'
