Tracy Morgan's lawyer, Benedict Morelli has revealed that the actor may never be able to perform again due to the brain injury he suffered in a fatal car crash in June.

In an interview with New York Post's Page Six, Morelli explained, "The jury's still out. The doctors don't know the answer. I don't know the answer," he said in response to questions of whether or not Morgan will still be able to return to acting and performing.

At present, Morelli is still recovering from the accident and regularly goes to rehab where he receives therapies to improve his speech and his cognitive and physical functions, according to the Hollywood Reporter.

A month after his accident, Morgan filed a lawsuit against Wal-Mart truck driver Kevin Roper and claimed that the man should not have been allowed to drive the truck especially since he was fatigued.

Earlier this week, Wal-Mart released its counter statement and alleged that Morgan's injuries were "caused, in whole or in part, by plaintiffs' failure to properly we an appropriate available seatbelt restraint device."

On Tuesday, Morgan released a statement in response to Wal-Mart's suit and said, "I can't believe Walmart is blaming me for an accident they caused. My friends and I are doing nothing wrong. I want to thank my fans for sticking with me during this difficult time. I love you all. I'm fighting hard every day to get back."

Meanwhile, following the crash that took the life of comedian James McNair, Roper, the truck driver was charged for allegedly causing the accident. He later on pled not guilty to the charges, the Daily Mail noted.

"The driver failed to observe slow-moving traffic ahead. He observed at the last minute - just prior to impact - the limo bus is carrying Morgan and his party," New Jersey State Police Sgt. First Class Gregory Williams said at that time.
