Rod Stewart, who is known for kicking soccer balls into the audience during his concerts, has been sued by a fan after one of these balls smashed in his face and broke his nose at a concert at Caesar's Palace in Las Vegas back on Oct. 7, 2012, Courthouse News reported.
In the lawsuit filed by Mostafa Kashe in Clark County district court in Nevada Monday, Sept. 22, he claims that the 69-year-old British rock singer-songwriter "intentionally kicked multiple soccer balls into the crowd of the concert," adding that the Grammy-winning recording artist was "negligent, careless, and/or reckless, and the soccer balls were kicked with sufficient force so as to potentially injure patrons of the concert," according to The Wrap.
Kashe further claims that he was "unexpectedly hit in the face by a soccer ball kicked from the stage" by Stewart, which fractured his nasal cavity and caused other injuries requiring medical and cosmetic attention.
The complainant sued the "Sailing" hitmaker, Caesar's Palace and concert promoter AEG Live, accusing them of negligence and failure to warn.
"Stewart has significant experience in the sport of soccer and experience in kicking soccer balls, having previously tried out for a professional soccer team in the UK and regularly playing in amateur soccer leagues since his youth," the complaint claims, according to the New York Post.
"Stewart either knew or should have known that his actions could cause injury to unsuspecting patrons of his concerts," said Kashe, adding that venue officials and concert promoter knew or "should have been aware of Stewart kicking soccer balls without warning into the crowd as part of his show."
Kashe, who had to leave his Las Vegas vacation with his family early after the incident and continues to suffer from mental and physical pain, is seeking special, general and compensatory damages exceeding $10,000, lost wages, attorney's fees and cosmetic damages that could be permanent.
