Katherine Heigl  has dropped her $6 million lawsuit against drugstore giant Duane Reade for posting on Twitter and Facebook a paparazzi photo of her carrying the chain's shopping bags.

The 35-year-old "Grey's Anatomy" alum voluntarily dismissed her Manhattan federal court suit, and in exchange, the drugstore chain has made an undisclosed contribution to the Jason Debus Heigl Foundation, an animal-welfare charity that Heigl and her mother founded in honor of her late brother, Jason, who was killed in a 1986 car accident, Page Six reported

"Katherine Heigl and Duane Reade have worked out a mutually beneficial agreement," said Peter Haviland at Ballard Spahr, according to The Hollywood Reporter. "Ms. Heigl has voluntarily dismissed her lawsuit, and Duane Reade has made a contribution to benefit the Jason Debus Heigl Foundation.  The parties have agreed to keep the terms of the agreement confidential."

The dismissal of the lawsuit comes with prejudice, which means the Golden Globe-nominated actress can no longer sue over the drugstore chain's tweet and Facebook posts, THR noted.

According to the lawsuit filed on April 9, the drugstore chain tweeted a photo of Heigl on March 18, carrying two Duane Reade bags along with a caption: "Love a quick #DuaneReade run? Even @KatieHeigl can't resist shopping #NYC's favorite drugstore."

The shot was taken on March 16 when the actress made an errand run at the chain's Manhattan store while she was in New York filming a pilot episode for a new television series, Reuters reported.

The lawsuit also noted that the photo was also used on Duane Reade's Facebook account, falsely implying that the actress endorses the company.

"The Heigl photograph is a typical 'paparazzi' shot, depicting plaintiff walking on the street in New York City, in a private moment looking away from the camera," the lawsuit said. "Use of plaintiff's image under these circumstances improperly exploited plaintiff's name and likeness, as a celebrity, for defendant's commercial advertising and purposes of trade, without authorization."

Meanwhile, Heigl is set to make a big comeback to television in the new espionage thriller series, "State of Affairs," which will premiere on NBC on Nov. 17.
